Project Management Pros collects information in several ways. At checkout, your contact information is collected for the purpose of processing your order and to set up your account on this website. This information may also be used for internal sales and marketing purposes. We may also collect your credit card number, expiration date, and security code. This information is securely passed to our payment gateway, Stripe, to process your purchase. The last 4 digits of your credit card number and the expiration date are saved by our site to use for reference and to send you an email if your credit card will expire before the next recurring payment.

Any information provided through a form, comment, chat widget, or email may be used for security purposes such as spam detection, as well as internal sales and marketing purposes. This includes your IP address and browser user agent string. Web browsing activity and geolocation may be tracked to improve the website and for marketing purposes. Some of the information we gather from you, including but not limited to first name and city, may be displayed on the website for other viewers to see. We use cookies to track some of your activity on our site including logins, visits, page views, and video lessons marked complete.

All information about you and your visits on our website are retained indefinitely. This is so we can provide better customer service and more relevant marketing. For users that register on our website, we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

We will not disclose your personal information without your consent.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. Your profile picture may then be visible to the public in the context of the actions taken on our site, such as leaving a comment.

If you have an account on this site, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

Web pages on this site may include embedded content (e.g. videos, images, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.

These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracing your interaction with the embedded content if you have an account and are logged in to that website.

Access to your Asana or ClickUp workspace

In the course of training or consulting, we will often ask for access to your Asana or ClickUp workspace. We treat all client data confidentiality. If you no longer want Project Management Pros to have access to your data, you are responsible for deprovisioning any Project Management Pros users.

All deposits and payments are non-refundable. At our discretion, we may allow rescheduling of sessions for an additional fee. Project Management Pros reserves the right to cancel a training or service at any time prior to the start, in which case a full refund will be provided.

In the event Project Management Pros is unable to perform training or consulting duties during the agreed upon time period due to travel, technical difficulties, or other unforeseen difficulty, liability is limited to Project Management Pros’s choice of providing the client with a) additional training or consulting time equal to the time lacking or b) a refund of $30 for each 15 minute time period of the agreed time that Project Management Pros did not train or consult, up to the total balance due. At no time for any reason will Project Management Pros’s liability exceed a full refund.

For technical difficulties at the fault of the client, failure to provide information to Project Management Pros in a timely manner, or other issues at the fault of the client that affect the timeliness or quality of Project Management Pros’s work, no refunds will be provided.

When pre-purchasing consulting hours, the expectation is that they will be used around the time of purchase. Pre-purchased hours expire 120 days after purchase unless otherwise noted in an invoice or SOW.

All deposits and payments are non-refundable. Any membership with lifetime access means that if Project Management Pros chooses to no longer host the course online, members will have a minimum 14 days to download the course. All course materials are owned by Todd Cavanaugh and no part may be copied or distributed without expressed written consent.

Course memberships are purchased on a subscription basis unless otherwise stated. By purchasing a course, you are agreeing to recurring payments at the term identified during the purchase process. Subscriptions may be canceled at any time, in which case access to the course terminates at the end of the subscription period.

The initial purchasing account is the “primary account.” If you purchase additional licenses at a discounted rate, their access is connected to the primary account. This means if you do not renew your subscription, all discounted licenses will also lose access to the course.

A month of access is equivalent to 30 days, so a 6-month subscription would last 180 days before the next payment. Note this may not line up exactly with whichever day of the month the course was purchased (e.g. 180 days is not “8th of January to 8th of July”).

Purchasing access to the course (either lifetime or subscription) provides a license for one device at a time to access the course. You may not share user login credentials with multiple people. Multiple seats can be purchased at a discount; contact [email protected] for more information. The course may be displayed from a TV/projector in-person up to 100 people from one company. For groups over 100 people or representing multiple companies, please contact [email protected] for customized licensing.

All payments are nonrefundable. Exceptions will not be made due to acts of God, weather, sickness, work obligations, or any other reason. Project Management Pros reserves the right to cancel an event or session at any time and provide full refunds to registrants. Registration may be transferred to another person from the same workplace.

In the case of delayed travel due to reasons outside the control of Project Management Pros, Project Management Pros will make the decision either to cancel the event or arrive as soon as possible, even if it is a different day than what was originally planned. The client is responsible for all travel expenses, including unforeseen expenses related to travel delays or changes.

You may not record training sessions (in-person or virtual) without our written consent. A video/screen recording may be available for an additional $200 fee. Recordings may be used for internal use only. Please contact us if you are interested in purchasing a recording license.

For virtual training or consulting paid at an hourly rate, no-shows or cancellations occurring less than 12 hours before a session without approval may count as 1/2 billable time (e.g. 30 minutes billable for 60 minute session).

1. Agreement
The scope and terms associated with the Services along with these General Terms and Conditions are together one agreement between Project Management Pros and Client (or Customer), collectively referred to as the “SOW.” The SOW, together with all attachments, schedules, addenda, and exhibits, forms the entire agreement between the parties and supersedes any prior representations or agreements, oral or written, and all other communications between the parties relating to the subject matter of the SOW. Any conflicting additional or different terms contained in any other agreement, invoice, or statement of work are expressly rejected. In the event of a conflict between these General Terms and Conditions and Special Terms, Conditions, and Assumptions under the SOW, the Special Terms, Conditions, and Assumptions of this agreement shall take precedence. Any modification or waiver of the terms must be in writing and signed by both parties.

2. Term
The SOW begins on the date last signed by the Authorized Representative of each party (the “Effective Date”) and will expire upon one hundred and twenty (120) calendar days of the Effective Date or as otherwise provided in the SOW. The expiration of the SOW does not terminate the confidentiality obligations or any other provisions that are intended to survive termination.

3. Responsibilities
Customer will be responsible for responding to all requests for information in a timely manner. Customers are responsible for providing accurate and complete information during the meetings scheduled for that purpose and in any requested documentation.

4. Compensation Rates and Payment
Customer will pay Project Management Pros fees and expenses as set forth in the SOW or invoice. Except as otherwise established in the SOW or invoice, Customer will remit payment within 15 days of receipt of an invoice. Delayed payments will incur a service charge of an additional 5% per month from the day such amount is due until paid. Project Management Pros reserves the right to suspend services if payments are not received within the specified timeframe. All expenses incurred by Project Management Pros in providing the Services shall be reimbursed by the Client.

5. Intellectual Property
Customer agrees that all material and documentation identified as “Deliverables” in the Ordering Document, whether in final production or draft, contain proprietary information of Project Management Pros. Project Management Pros shall grant a perpetual, non-exclusive, royalty-free license to use Project Management Pros Material that is embedded in the Work Product to the customer. All Project Management Pros software, development tools, processes, methodologies, and techniques (“Project Management Pros Tools”) owned by Project Management Pros and incorporated into or embedded in Deliverables, or used in providing Services, shall remain the property of Project Management Pros. Upon termination, the Client shall return or destroy all Project Management Pros’ materials in its possession.

6. Confidential Information
To the extent that, in connection with this Agreement, either party (each, the “receiving party”) comes into possession of any trade secrets or other non-public proprietary or confidential information of the other party or third parties including Customer (the “disclosing party”) (“Confidential Information”), the receiving party will not disclose Confidential Information to any third party without the disclosing party’s consent. Additionally, the disclosing party hereby consents to the receiving party disclosing Confidential Information (i) to the extent required by law, rule, or regulation, or in accordance with applicable professional standards or rules or (ii) to the extent such information (A) becomes otherwise publicly available, (B) becomes available to the receiving party from a source other than the disclosing party which the receiving party believes is not prohibited from disclosing such information, (C) is known by the receiving party prior to its receipt from the disclosing party without any obligation of confidentiality, or (D) is developed by the receiving party without use of the disclosing party’s Confidential Information. The receiving party shall treat Confidential Information with at least the same degree of care as it employs in maintaining its own proprietary and confidential information, but in no event less than a reasonable degree of care. Upon termination or expiration, each party shall return or destroy all Confidential Information of the other party in its possession.

7. Limitation of Liability
Under no circumstances shall either party be liable to the other party for any consequential, indirect, punitive, special, exemplary, or incidental damages of any nature whatsoever, even if a party has been advised of the likelihood of such damages occurring. In no event shall Project Management Pros’ liability exceed the fees paid by the Client under the relevant SOW.

8. Termination
Either party may terminate this Agreement and/or any Ordering Document hereunder in whole or in part upon 30 days’ notice. Upon termination or expiration, the Client shall be liable for payment for services performed and any other documented commitments prior to termination or expiration. The Client shall return or destroy all Project Management Pros’ materials upon termination.

9. Governing Law and Jurisdiction
This Agreement will be governed by the law of the State of New York, United States of America, without giving effect to the conflicts of laws provisions thereof. Disputes shall be resolved through arbitration in a mutually agreed-upon jurisdiction.

10. Services Rendered
Services rendered by Project Management Pros may be completed by any employees or contractors of Project Management Pros as Project Management Pros sees fit to fulfill the deliverables of the SOW.

No information is shared with Project Management Pros or anyone else during a project cloning. No data is stored on the server and the API key is not retained between calls. No permanent cookies are stored, and your login token is only stored in a temporary cookie.

All data transfers are encrypted. However, we make no guarantees about information security. Do not use this tool if you are concerned about the security of confidential information.

No warranties or guarantees are made about the integrity of data or its confidentiality. Use this tool at your own risk. Project Management Pros or any of its representatives cannot be held responsible for any results of using this tool.

By accessing this web site, you are agreeing to be bound by these web site Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this web site are protected by applicable copyright and trademark law.

2. Use License

Further, Project Management Pros does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet web site or otherwise relating to such materials or on any sites linked to this site.

4. Limitations

In no event shall Project Management Pros or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Project Management Pros’s Internet site, even if Project Management Pros or a Project Management Pros authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

5. Revisions and Errata

The materials appearing on Project Management Pros’s web site could include technical, typographical, or photographic errors. Project Management Pros does not warrant that any of the materials on its web site are accurate, complete, or current.
